Colombia's tax system is administered by the DIAN (Dirección de Impuestos y Aduanas Nacionales) and governed primarily by the Estatuto Tributario, along with successive tax reform laws — most recently Ley 2277 of 2022, which introduced significant changes to income tax rates, capital gains treatment, and reporting obligations. For individuals, Colombia applies a progressive income tax system with rates up to 39% for tax residents, while non-residents face a flat 35% withholding rate on Colombian-source income. Tax residency is determined by the 183-day rule: any individual who spends more than 183 days in Colombia within a consecutive 365-day period is considered a tax resident and is subject to taxation on worldwide income.
Businesses operating in Colombia face a layered tax landscape that includes national taxes (income tax, IVA, withholding tax), municipal taxes (ICA — Industria y Comercio), and sector-specific obligations such as electronic invoicing mandates from the DIAN. The standard corporate income tax rate is 35%, and the general IVA rate stands at 19%. Companies must also act as withholding agents, collecting retención en la fuente on payments to employees, contractors, and suppliers. Failure to comply with withholding obligations carries severe penalties, including personal liability for company directors.
At Legal Diligence Medellín, our tax team advises both Colombian businesses and foreign nationals on tax planning, DIAN compliance, treaty benefits, and strategic structuring. Whether you are an expat establishing tax residency, a foreign investor acquiring property, or a company navigating electronic invoicing requirements, our lawyers provide the technical guidance you need to remain compliant while minimizing your tax burden within the law.
